Chuvé Terms of Use

These Terms of Use ("Terms") are an agreement between you and [Legal name], a sole proprietor doing business as Chuvé in Seoul, Republic of Korea ("Chuvé," "we," "us"). By downloading or using the Chuvé app or website, you agree to these Terms. If you don't agree, don't use Chuvé.

1. Who can use Chuvé

You must be at least 18 years old. By using Chuvé, you confirm that you are. If we learn that a user is under 18, we may end their access.

2. What Chuvé is — and isn't

• Chuvé provides in-app makeup guidance: placement, technique, and routines built from the choices you make.
• Chuvé guides are in-app tips, not live consultants. No person reviews your photos or results.
• Chuvé is not medical, dermatological, or skin-care treatment advice. It doesn't diagnose, treat, or improve any skin or health condition.
• Results depend on your products, lighting, and practice. We don't promise any particular look or result.

3. Your safety

• Patch test new products first. If you feel irritation or discomfort, stop using the product right away and seek medical advice if needed.
• Follow the instructions and warnings that come with each product you use.
• Never apply products to the waterline or inner eye, and don't use lip products on your eyes.
• Chuvé doesn't make or sell cosmetics and isn't responsible for products you choose to use.

4. Purchases

All purchases are made through Apple's App Store and are governed by Apple's terms. Prices are shown in the app before you buy. Every Chuvé product is a one-time purchase. There are no subscriptions and nothing renews automatically.

• Yours to keep: what you buy stays unlocked for as long as Chuvé offers the app. You can restore purchases on another iPhone signed in to the same Apple ID by tapping Restore purchases in the app.
• Program order: everyone starts with the 7-Day Kit. Within a stage, weeks open one at a time; stages open in order. Some later-stage content is released after launch, and we'll make each stage available before you reach it.
• Free and discounted offers: when we offer a product free or at a lower price (for example, during launch, to founding members, or as a referral reward), it's delivered through Apple's offer code system or shown as the App Store price.
• Family Sharing: Chuvé purchases aren't shared through Family Sharing.
• Refunds: Apple handles all refunds. You can request one at reportaproblem.apple.com.

5. Founding members and gift links

• Founding member benefits, numbering, and limits are described in the Official Rules at https://chuve.app/rules and on the pre-registration page.
• Your Founding Pass link confirms that you pre-registered. Any free or discounted product is then delivered through Apple's offer code system, not unlocked by us directly.
• Founding Passes and gift links are personal. They can't be sold, transferred, or exchanged for cash.
• Referral rewards count only when the invited person installs Chuvé and reaches Day 7. We may cancel rewards obtained through fake installs, multiple devices controlled by one person, or other abuse.
• Referral rewards (such as a Stage 1 code you can use or give to a friend) are delivered through Apple's offer code system, not unlocked by us directly.
• We may change or end the founding member or referral programs, but we'll honor benefits already earned.

6. Your photos and data

• Your photos and studio data belong to you. They're stored on your device and, if enabled, in your private iCloud. We don't receive them.
• Our Privacy Policy explains what we do receive and how you can delete it.
• Reset studio data permanently deletes Chuvé data on your device. We can't recover it for you.
• Only use Chuvé with photos of yourself. Don't photograph or upload other people.

7. Product links

Chuvé may link to products sold by third parties, such as Olive Young US. We may earn a commission when you buy through these links. Those products and purchases are between you and the seller; we're not responsible for their products, prices, shipping, or returns.

8. Acceptable use

Don't:

• copy, resell, or redistribute Chuvé's content;
• reverse engineer the app or interfere with its servers, except as the law allows;
• abuse the founding member, offer, or referral systems;
• use Chuvé for any unlawful purpose.

9. Our content

The app, its lessons, text, illustrations, and design belong to Chuvé or our licensors. We give you a personal, non-transferable, non-exclusive license to use the app on Apple devices you own or control, as permitted by Apple's Usage Rules. All rights not granted are reserved.

10. Changes and termination

• We may update Chuvé and these Terms. If we make a material change, we'll update the effective date and tell you in the app. Continuing to use Chuvé after that means you accept the changes.
• You can stop using Chuvé anytime. We may suspend access if you seriously or repeatedly break these Terms.
• If we ever shut down Chuvé, we'll give at least 30 days' notice in the app where possible.

11. Disclaimers and limits of liability

• Chuvé is provided "as is" and "as available." To the extent the law allows, we disclaim implied warranties, including fitness for a particular purpose.
• To the extent the law allows, we're not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid for Chuvé in the 12 months before the claim.
• Nothing in these Terms limits rights you have under consumer protection laws that can't be waived. Some places don't allow these disclaimers or limits, so they may not apply to you.

12. Governing law and disputes

• Please contact us first at [email protected]; most problems can be solved quickly.
• These Terms are governed by the laws of the Republic of Korea. This doesn't remove protections you have under the mandatory consumer laws of the place where you live, and you may bring a claim in the courts where you live if those laws allow it.

13. Apple-required terms

1. These Terms are between you and Chuvé only, not Apple. Chuvé, not Apple, is solely responsible for the app and its content.
2. Your license to use the app is limited to a non-transferable license on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
3. Apple has no obligation to provide maintenance or support for the app.
4. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the app. Any other claims, losses, or costs from a failure to conform to a warranty are Chuvé's responsibility.
5. Chuvé, not Apple, is responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy, or similar laws.
6. If a third party claims that the app or your use of it infringes their intellectual property rights, Chuvé, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
7. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

9. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
